Europarådets parlamentariska församling. I betänkandet behandlas
vidare en motion som väckts med anledning av skrivelsen samt två
motionsyrkanden från allmänna motionstiden hösten 2010.

In this report, the Committee deals with the Government's letter
2010/11:54 Review of operations within the Council of Europe
Committee of Ministers, etc. for the year 2009 and first half
of 2010 and to the report to Parliament in
2010/11:ER1 from Sweden's delegation to the Parliamentary
Assembly of the Council of Europe. The report also deals with a
motion brought in the light of the letter as well as two motions
from the general motion period in autumn 2010.

In the Committee motion
2010/11:U298 point 13 the Left Party emphasizes that in October
2010, the European Council decided on a resolution which means that
employees in the health sector will be able to choose not to perform
abortions. Even entire hospitals may to refuse to provide abortion
services. The motion emphasizes that the European Council resolution
is a major setback for European women. Sweden must now work actively
to rescind the resolution.

Motionsvis uppmärksammas Europarådets parlamentariska församlings
Resolution 1763 (2010), antagen den 7 oktober 2010, som bl.a.
innebär att anställda inom vården ska kunna välja att inte utföra
aborter. Utskottet har tidigare tagit ställning till frågan om
abort, t.ex. i betänkande 2009/10:UU15 Mänskliga rättigheter i
svensk utrikespolitik. Utskottet står fast vid sitt tidigare
konstaterande att Sverige stöder insatser som syftar till att göra
aborter fria, säkra och lagliga för alla kvinnor. Sverige är ett av
de länder som är ledande i det internationella arbetet när det
gäller att lyfta fram frågor om sexuell och reproduktiv hälsa och
rättigheter (SRHR). Sveriges internationella SRHR-politik ligger
fast. Utskottet noterar även att abortfrågan inte omfattas av EU:s
fördrag. Utskottet förhåller sig kritiskt till innehållet i
Resolution 1763 (2010) och anser att delegationen bör verka för
att åstadkomma en förändring av denna resolution.

The motion is addressed to the Council of Europe Parliamentary
Assembly
Resolution 1763 (2010), adopted on 7 October 2010, which means
that employees in the health sector should be able to choose not to
perform abortions. The Committee has previously taken a position on
the issue of abortion, for example, in report 2009/10: UU15 human
rights in Swedish foreign policy. The Committee maintains its
previous finding that Sweden supports efforts aimed at making
abortion free, safe and legal for all women. Sweden is one of the
countries that are leaders in international efforts to highlight the
issues of sexual and reproductive health and rights (SRHR). Sweden's
international SRHR policy remains unchanged. The Committee also
notes that the abortion issue is not covered by the EU Treaty. The
Committee is critical of the content of
Resolution 1763 (2010) and considers that the delegation should
work to bring about a change in the nature of this resolution.

I oktober 2010 valde Europarådet att på ett skrämmande sätt
försvaga kvinnors rätt till sin egen kropp ytterligare. Europarådet
beslutade då om en resolution som innebär att anställda inom vården
ska kunna välja att inte utföra aborter. även hela sjukhus ska kunna
neka att utföra abortverksamhet.

In October 2010 the Council of Europe chose in a horrifying way
to weaken women's rights to their own bodies further. The Council of
Europe passed a resolution that means that employees in the health
sector should be able to choose not to perform abortions. Even whole
hospitals may refuse to perform abortion operations.

Kvinnors rätt att bestämma över sin egen kropp, sexualitet och
reproduktion är en grundläggande mänsklig rättighet. Att begränsa
möjligheten till abort på det sätt som resolutionen föreslår skulle
innebära direkta brott mot kvinnors mänskliga rättigheter.
|
Women's right to control their own bodies, sexuality and
reproduction is a fundamental human right. To limit the possibility
of abortion, as the resolution proposes, would mean direct
violations of women's human rights.
|
| Europarådets resolution är inte juridiskt bindande
men måste betraktas som ett stort bakslag för europeiska kvinnor och
visar tyvärr på de konservativa vindar som nu blåser genom Europa.
Alltför få länder och regeringar är beredda att stå upp och försvara
kvinnors sexuella och reproduktiva rättigheter. Om Sverige tystnar
är risken tyvärr stor att inga andra länder kommer att försvara
dessa grundläggande mänskliga rättigheter. Vi hade önskat att
Sverige tydligt tog avstånd från resolutionen och aktivt arbetade
för att den upphävs. |
The European Council resolution
is not legally binding but must be seen as a major setback for the
European women and unfortunately shows conservative winds blowing
through Europe. Too few countries and Governments are prepared to
stand up and defend women's sexual and reproductive rights. If
Sweden remains silent, the risk is unfortunately very great that no
other countries are going to defend these fundamental human rights.
We had hoped that Sweden would clearly dissociate itself from the
resolution and actively work for the repeal. |

Med anledning av motion
2010/11:U298 av Hans Linde m.fl. (V) har Europarådets
resolution 1763 (2010) om samvetsfrihet uppmärksammats i
utskottets betänkande. I motionen yrkar Hans Linde m.fl. (V) att
riksdagen tillkännager för regeringen som sin mening vad som anförs
i motionen om att upphäva Europarådets resolution om samvetsfrihet.

Following motion
2010/11: U298 by Hans Linde (V), the European Council
Resolution 1763 (2010) on freedom of conscience has been noted
in the Committee's report. In his motion Linde (V) would have
Parliament declare to the Government, as stated in the motion, that
the European Council resolution on freedom of conscience should be
abrogated.

Resolution 1763 (2010) handlar om att ingen person, inget
sjukhus och ingen institution ska tvingas att utföra eller medverka
till abort, dödshjälp eller någon handling som kan orsaka döden för
ett mänskligt foster eller embryo. Vidare säger resolutionen att
ingen ska diskrimineras om man vägrar medverka till något av detta.
Resolutionen slår också fast att samtidigt som medlemsstaterna ska
upprätthålla respekt för tankefrihet, samvetsfrihet och
religionsfrihet ska man också försäkra tillgång till vård och hälsa. |
Resolution 1763 (2010) is that no person, no hospitals and no
institution should be forced to perform or contribute to abortion,
euthanasia, or any act that may cause the death of a human embryo or
foetus. Furthermore, the resolution says that no one shall be
discriminated against if they refuse to participate in any of these
procedures. The resolution states that while Member States must
maintain respect for freedom of thought, conscience and religion,
they must also ensure access to health care and treatment. |

förslag att avslå motionen men vi kan inte ställa oss bakom
utskottets överväganden och motiv till att avslå motionen. |
Swedish Democrats endorse the
Committee's proposal to reject [Hans Linde's] motion but we cannot
support the Committee's considerations and motives for dismissing
the motion. |

| I utskottets överväganden står man fast vid
tidigare ställningstaganden i exempelvis betänkande 2009/10:UU15 att
Sverige ska stödja internationella insatser som syftar till att göra
aborter fria, säkra och lagliga för alla kvinnor. I utskottets
överväganden står det även att "utskottet förhåller sig kritiskt
till innehållet i
Resolution 1763 (2010) och anser att delegationen bör verka för
att åstadkomma en förändring av denna resolution, vilken antogs vid
en tidpunkt då den svenska delegationen inte kunde närvara." |

considerations are being fixed at previous positions, such as report
2009/10: UU15 that Sweden should support the international efforts
aimed at making abortion free, safe and legal for all women. In the
Committee's deliberations, it says that "the Committee is critical
of the content of
Resolution 1763 (2010) and considers that the delegation should
work to bring about a change in the nature of this resolution, which
was adopted at a time when the Swedish delegation was unable to
attend." |
| Utifrån dessa ovanstående överväganden anser
utskottet att
motion 2010/11:U298 yrkande 13 kan avstyrkas. |

considerations the Committee can disagree with
2010/11: U298 claim 13. |
| Sverigedemokraternas motiv till att motionen ska
avstyrkas är tvärtom att vi ställer oss positiva till Europarådets
Resolution 1763 (2010) om samvetsfrihet, och vi kan inte ställa
oss bakom att delegationen ska verka för att åstadkomma en
förändring av resolutionen. Sverigedemokraterna vill i stället
poängtera vikten av att respektera artikel 18 i FN:s allmänna
förklaring om de mänskliga rättigheterna där det står att "var och
en har rätt till tankefrihet, samvetsfrihet och religionsfrihet." |
To the contrary, Swedish
Democrats justification for the motion to reject is that we are in
favour of the European Council
Resolution 1763 (2010) on freedom of conscience, and we cannot
support that the delegation should act to bring about a change in
the resolution. Swedis Democrats want instead to stress the
importance of respecting article 18 of the Universal Declaration of
human rights, which States that "everyone has the right to freedom
of thought, conscience and religion." |

vara vaksam på att man inte kliver över gränsen från att arbeta för
internationella mänskliga rättigheter till att ställa orimliga krav
på enskilda länders politiska inriktningar. Vi tror i stället på att
stärka demokratin samt åsikts- och yttrandefriheten i
mottagarländerna. Vi ställer oss bakom FN:s allmänna förklaring om
de mänskliga rättigheterna men ställer oss kritiska till att använda
biståndspengar för att utöva politiska påtryckningar på andra
länders abortpolitik. |
We think that the abortion
issue is of such a complex nature that we should respect that other
countries may have a different view on abortion than that found in
Swedish legislation. We believe that we should be careful not to
cross the line from working for international human rights to making
unreasonable demands on individual countries ' policies. We believe
instead in strengthening democracy and freedom of opinion and
expression in the recipient countries. We support the Universal
Declaration of human rights but are critical of using development
assistance money to apply political pressure on other countries'
abortion policies. |
