AN ACT granting immunity from liability to pharmacists
who refuse to dispense an emergency contraceptive pill.
Be it Enacted by the Senate and House of Representatives in
General Court convened:
1 New Section; Pharmacists; Immunity. Amend RSA 318 by inserting after
section 13 the following new section:
318:13-a Immunity From Liability for Pharmacists Refusing to
Dispense Emergency Contraceptive Pill.
No administrative proceeding shall be maintained by the board, no
employment action or grounds for termination or discipline shall be
maintained by an employer, and no civil action shall be maintained by
any person, against a pharmacist licensed by the board who, in the
performance of his or her duty under this chapter, refuses to provide an
emergency contraceptive pill or "morning after pill" to any person with
or without a prescription. A pharmacist shall incur no liability for
such a refusal.
2 Effective Date. This act shall take effect upon its passage.
